Agreement

These terms are a contract between you and Oneshotgems and apply whenever you use Oneshotgems on the web or in our apps. By creating an account or using Oneshotgems you agree to them and to our privacy policy. If you don't agree, please don't use Oneshotgems.

Who can use Oneshotgems

You must be at least 13 years old, or the minimum age of digital consent in your country if higher. If you are under 18, you confirm a parent or guardian has agreed to these terms, and purchases need their permission. You may not use Oneshotgems if you've been banned from it before.

Your account

Keep your password secret and your details accurate. You're responsible for activity on your account. Tell us at [email protected] if you think someone else is using it. Usernames must not impersonate anyone or mislead; we may reclaim usernames that do, or that are inactive for a long time.

Your content

"Your content" means prompts, comments, profile details and anything else you post, plus games generated from your prompts ("prompted games").

You keep your rights in your content, to the extent you have them.
Licence to us: you grant Oneshotgems a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for example resize, re-encode or thumbnail), publish, display and distribute your content in order to operate, promote and improve Oneshotgems. This licence ends when you delete the content or your account, except for copies already shared by others, cached, or kept in backups for a limited time, or where we must keep it for legal reasons.
Licence to other players: other players may play, share links to and comment on your public content within Oneshotgems.
Public by default: prompted games, including your prompt text, are public and credited to your username.
Your promises: you have the rights needed to post your content, and it follows these terms and the law.

AI-generated games

Oneshotgems uses AI to generate games, including personal gems made for you and games made from your prompts.

Output can be imperfect. Generated games may contain bugs, be unbalanced, or occasionally be similar to other games. We run automated quality and safety checks, but we don't guarantee any game will work or be available forever.
Ownership: as between you and us, you may use prompted games made from your prompts for personal, non-commercial purposes. Oneshotgems may use all generated games, including personal gems, to operate Oneshotgems; personal gems may be shown to other players anonymously.
Don't prompt for prohibited content (see the community rules), and don't try to make the generator produce malware, collect data, or break out of the game sandbox.
We may decline a prompt, reject a generated game, or remove a game at any time, for example if it fails a safety check.

Community rules

Keep Oneshotgems fun and safe. Don't post, prompt or share anything that:

is sexual, sexualises minors in any way, or is graphically violent or gory;
harasses, bullies, threatens, or promotes hatred against people based on who they are;
promotes self-harm, suicide, eating disorders, dangerous challenges, weapons, or illegal drugs;
copies someone else's game, characters, brand, music or art without permission;
impersonates a person or organisation, or shares someone's private information;
is spam, scams, advertising, or manipulates likes, follows or plays;
contains malicious code, or attempts to access other users' data or our systems.

Zero tolerance. We have zero tolerance for objectionable content and abusive users: content that breaks these rules is removed, and accounts that post it are suspended or banned.

Reporting and moderation. You can report any game, comment or user, and block users (blocking hides their content from you straight away). Our team reviews reports within 24 hours and may remove content, restrict features, suspend or ban accounts, and where appropriate notify authorities. If we remove your content or restrict your account we will tell you why where we can, and you can appeal by replying or emailing [email protected].

Subscriptions and payments

Plus is a paid subscription that renews automatically each month or year until you cancel. The price, and what's included, are shown before you buy. Daily limits and generation schedules are fair-use limits and may change; we'll tell you in advance of material changes.
Free trials: if offered, the trial converts to a paid subscription at the end unless you cancel before it ends. One trial per person.
Cancelling: cancel any time and keep Plus until the end of the current period. Web: Profile → Settings → oneshotgems plus. iPhone/iPad: Settings → your name → Subscriptions → Oneshotgems. Android: Google Play → Profile → Payments & subscriptions → Subscriptions → Oneshotgems.
App Store purchases: subscriptions bought through Apple are also governed by Apple's Licensed Application End User License Agreement. Payment is charged to your Apple ID and renews automatically unless cancelled at least 24 hours before the end of the current period. Google Play purchases are also subject to Google Play's terms.
Price changes: we'll give you notice before a price change applies to your subscription, and you can cancel before it does.
Refunds: web purchases can be refunded where the law requires, or at our discretion if something went wrong; email [email protected]. App Store and Google Play purchases are refunded by Apple or Google under their policies.
Consumers in the UK and EU: you have a 14-day right to cancel a new subscription. By starting to use Plus straight away you agree it begins immediately; if you cancel within 14 days we may deduct an amount for the time already used.

Our content and your licence to use Oneshotgems

Oneshotgems, its software, design, brand and the games we provide (other than your content) belong to Oneshotgems or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Oneshotgems for your own non-commercial entertainment, under these terms. Don't copy, scrape, reverse engineer, resell, or build a competing service from Oneshotgems or its games, or access it with bots except via features we provide.

Copyright and trade mark claims

If you think content on Oneshotgems infringes your rights, email [email protected] with: your contact details; the work you believe is infringed; the link to the content; a statement that you believe in good faith the use isn't authorised; and a statement, under penalty of perjury, that your notice is accurate and you are the rights holder or authorised to act for them. We remove infringing content and terminate repeat infringers' accounts. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address.

Ending your use

You can stop using Oneshotgems and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Oneshotgems; where reasonable we'll tell you first. If we close Oneshotgems entirely we will refund any unused prepaid subscription period for web purchases.

Disclaimers

Oneshotgems is provided "as is". We work hard to keep it running and safe, but we don't promise it will always be available, error-free, or that every game will be suitable for everyone. Games are for entertainment; educational games are not a substitute for professional advice. Take breaks. Some games include flashing lights and fast motion; if you have photosensitive epilepsy, take care.

Nothing in these terms limits rights you have as a consumer that can't be limited by contract.

Liability

We are not liable for losses that were not reasonably foreseeable, for business losses, or for content posted by other players. To the extent the law allows, our total liability to you for any claim is limited to the greater of US$100 and the amount you paid us in the 12 months before the claim. We don't exclude liability for death or personal injury caused by our negligence, fraud, or anything else that can't be excluded by law.

Changes

We may update these terms as Oneshotgems evolves or the law changes. For material changes we'll give you reasonable notice in the app or by email. If you keep using Oneshotgems after the change applies you accept the new terms; if you don't agree, you can delete your account.

Law and disputes

These terms are governed by the laws of England and Wales, and disputes go to its courts. If you live elsewhere as a consumer, you also keep the protection of the mandatory laws of your country and can bring claims in your local courts.
